By signing this order form, or sending us your payment details by email, you are agreeing to receiving the number of stated hours on the proposal and also paying for the number of hours of tuition stated.
Trainers are allocated to you (the client) according to a combination of your linguistic needs and your geographical location. All trainers are vetted by Cactus Language Training (Cactus) and are guaranteed to be qualified to the appropriate levels.
Please notify Cactus Language Training immediately if there are any problems relating to either course content and/or your trainer. We will try to solve any challenges in the fastest and most efficient way.
Please ensure that any premises (work or home) used for classes conform to basic Health & Safety standards.
Lesson time or day modifications must be reported to Cactus at least 24 hours before the start time of the lesson. Otherwise, they will be considered late cancellation and they will be billed by Cactus in full.
Any changes in class size, training conditions, or frequency of courses should be informed directly to Cactus Operations Manager or Account Manager by phone or email.
The trainer has the right to withdraw from training if unprofessional or discourteous behaviour is in evidence or if you are unfit for the lesson due to intoxication or other similar factors.
Trainer delays due to transport problems may be rescheduled (with the client's consent) or the time may be made up at the end of the lesson. Client delays may be made up by direct arrangement with the trainer.
Trainers are on assignment from Cactus, and as such, clients may not discuss or enter into individual agreements with the Cactus trainer.
Cactus must be informed of any location changes at least 48 hours in advance of the starting time of the lesson, and it requires consent from the trainer. Any applicable increased travel expenses due the change will be billed to the client.
Cactus reserves the right to take a maximum of 28 days (4 weeks & 4 weekends) to source a trainer for the client.
Payments and Refunds
Standard payment terms are 30 days from the date of invoice. We reserve the right to cancel future lessons should payments terms not be adhered to. Payment must be received or organised in advance of lessons taking place. The invoice amount includes course materials and trainer travelling time unless otherwise stated.
Invoices remaining unpaid for more than 30 days from the invoice date will accrue interest at the rate of 2% per calendar month.
Refunds will only be made for future lessons which have already been paid where Cactus Language Training is unable to provide the level and quality of training described in the course proposal. Where a client is unable to continue with his or her lessons for any reason, a credit note will be issued to be used by the same client or organisation for future language training within a period of 12 months.
Any paid lessons need to be used or scheduled by the client within a period of 12 months from the invoice date. Any non-scheduled lessons after that 12 month period will be cancelled and no refund will be made.
If a course is cancelled with less than 14 days and more than 7 days prior to the course start date, a payment of 10% of the total cost of the course agreed is payable to Cactus.
If a course is cancelled with less than 7 days notice before the course start date a payment of 25% of the total cost of the course agreed is payable to Cactus.
Please note that all bank charges are to be paid by the sender.
When booking a course with Cactus, please ensure that we have a correct email address to which to send your invoice / receipt as we do not send invoices in the post unless specially requested to do so.
